Terms of use

These terms govern your use of BuilderCapital at buildercapital.ai and app.buildercapital.ai (the "Service"), operated by LIMITLESS Capital LLC ("we", "us"). By creating an account or using the Service you agree to them. If you use the Service for a company, you agree on its behalf and confirm you're authorised to.

What BuilderCapital is, and isn't

BuilderCapital is software that helps builders, brokers and lenders organise construction and land development loan requests and share them with each other. We are not a lender and do not make credit decisions, issue loan commitments, or negotiate terms for you.

Loan sizing, readiness scores, comparisons, and anything produced by AI (such as terms read from a term sheet or a suggested folder for a document) are indicative estimates to help you, not advice or a commitment to lend. Check them yourself. Every lender makes its own decision on its own terms.

Your account

• You must be at least 18 and give accurate information.
• Keep access to your email account and any password secure. You're responsible for activity under your account.
• Invitations are personal to the email address they were sent to. Don't share or forward invitation links or sign-in codes.

Your content

You keep ownership of the information and documents you add ("your content"). You give us permission to store, process and display your content only as needed to run the Service for you, including showing it to the people you choose to share it with and processing it with our service providers (for example, AI reading of a document you upload).

You confirm you have the right to share your content, including any information about other people (such as a guarantor's financial statement), and that sharing it doesn't break any agreement or law.

Information other users share with you

Deal information shared with you on BuilderCapital is confidential. Use it only to evaluate or work on that deal, don't share it outside your organisation without the owner's permission, and delete it when you no longer need it, unless the law or your own record-keeping rules require you to keep it.

Acceptable use

Don't:

• upload anything unlawful, misleading or that you don't have the right to share;
• try to access deals, rooms or accounts you weren't invited to, or get around the Service's security or access controls;
• scrape, copy or resell the Service or other users' information;
• use the Service to send spam or to harass anyone.

We may suspend or close accounts that break these terms.

Fees

The Service is currently free. We may introduce paid plans or features later. We'll tell you in advance, and you won't be charged unless you choose a paid plan.

Availability and changes

We work to keep the Service available and your content safe, but we can't promise it will always be uninterrupted or error-free. Keep your own copies of important documents. We may change or discontinue features. If we change these terms in a meaningful way, we'll update the date above and tell account holders.

Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that any deal will be financed, or the accuracy of information other users provide.

Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or financing opportunities. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

Indemnity

You agree to defend and indemnify us against claims arising from your content, your use of information shared with you, or your breach of these terms.

Ending your use

You can stop using the Service and ask us to delete your account at any time. Sections that by their nature should continue (such as confidentiality, disclaimers, limitation of liability and indemnity) survive.

Governing law

These terms are governed by the laws of the State of Washington, and disputes will be resolved in the courts of King County, Washington, unless the law where you live requires otherwise.
